13. No Guarantee of Services or Outcomes

Submitting a form, inquiry, or application through this Site does not guarantee:

• acceptance into any program

• matching with a surrogate or intended parents

• eligibility for surrogacy services

• any particular timeline

• any medical, legal, or personal outcome

All services are subject to screening, eligibility, availability, and separate agreements.

14. Communications

By submitting your contact information through the Site, you consent to receive communications from us related to your inquiry or our services, including by email, phone, or text message, unless you opt out where applicable.

Message and data rates may apply for text messages.

15. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.

Any dispute not subject to arbitration shall be brought in the state or federal courts located in Charleston, South Carolina, and you consent to the jurisdiction of those courts.

16. Dispute Resolution and Arbitration

You and Better Journey Surrogacy agree to try to resolve disputes informally first by contacting each other in good faith.

If a dispute cannot be resolved informally, you and Better Journey Surrogacy agree, to the fullest extent permitted by law, to resolve disputes arising out of or relating to these Terms or the Site through binding individual arbitration, and not in court, except for matters that may be brought in small claims court.

You and Better Journey Surrogacy also agree that any arbitration will proceed on an individual basis only, and not as part of a class, consolidated, coordinated, or representative action.

Any arbitration under this section will be administered by JAMS under its applicable rules. If arbitration is found unenforceable for a particular dispute, that dispute must be brought in the state or federal courts located in Charleston, South Carolina, and both parties consent to that venue.

17. Changes to These Terms

We may revise these Terms from time to time. When we do, we will post the updated version on this page.

Your continued use of the Site after updated Terms are posted means you accept the revised Terms.

18. Severability and Waiver

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

19. Entire Agreement
